Blumo Terms and Conditions

There is no charge for this service, but Messaging & Data Rates May Apply when sending messages to or receiving messages from the Blumo short code: 25866.

1. "Text to Win" (TXT2Win) competitions are provided by BLUMO INC (P.O. Box 3226, Gilbert, AZ 85299-3226) on behalf of a client sponsor (Sponsor).

2. Information on how to enter and the prizes form part of these terms and conditions. By sending an SMS to 25866, you acknowledge that you have read and understood and agree to be bound by these terms and conditions.

3. TXT2Win competitions are open to United States residents over the age of 18 years. If you are under 18 years of age you must have the approval of your parent or guardian over the age of 18 years. Employees and agents of Blumo, employees and agents of Sponsor, and their immediate families are not eligible to enter the Competition. If the winner is under 18 years of age, the prize will be awarded to the winner's parent or guardian.

4. The SMS entry mechanic is only open you if you have an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that you check with your individual service provider in this regard. SMS entries via the internet or computer generation are invalid and will not be accepted. To be valid the mobile number from which each SMS is sent must not be withheld and the mobile number must be owned by the entrant.

5. Your mobile phone provider may charge for sending and receiving SMS messages. You will need to check with your provider to determine if there are additional costs.

6. A TXT2Win Competition consists of you sending an SMS to obtain entry instructions in a reply SMS and you sending a further SMS entry containing the competition keyword set out in the TXT2Win Competition call-to-action.

7. Winners will be contacted via a phone call and/or SMS to their mobile telephone number.

8. If for some reason beyond Blumo's or Sponsor's control, it is not possible to supply the prize as advertised, Sponsor will be entitled to supply a substitutable item in Sponsor's discretion of equal or greater value.

9. Prizes are not transferable. No compensation is payable if the winner cannot receive any aspect of the prize for any reason. Prize value is correct at time of printing and Blumo accepts no responsibility for any variation.

10. There are no other obligations, such as an obligation to purchase goods or services, connected to participation.

11. By entering a TXT2Win Competition, unless stated otherwise by the entrant, entrants agree that Blumo and Sponsor may use the entrant's contact details in any media for future promotional, marketing or publicity purposes without further reference or consent including sending the entrant further electronic messages. Entrant further agrees that if they opt-in to be contacted by Blumo or Sponsor, this opt-in overrides any previous opt-out by entrant and Blumo or Sponsor shall be allowed to initiate contact with the entrant. Blumo will collect personal information about you for the purposes of conducting a TXT2Win Competition and awarding prizes. Data may be passed to United States mobile operators upon their request. Please refer to Blumo's privacy policy on www.blumo.com for further details.

12. If the Competition is not capable of running as planned due to any reason (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures or any other causes) Blumo reserves the right without liability to you to cancel, modify, terminate or suspend a TXT2Win Competition.

13. Blumo is not responsible for any technical error that may occur during a TXT2Win Competition. This includes, but is not limited to, any omission, interruption, deletion, defect or delay in operation or transmission or failure of any telephone, mobile or satellite network.

14. Blumo is not responsible for any misdirected, late or incomprehensible entries in a TXT2Win Competition.

15. Blumo is not responsible for any tax implications that may arise from winning a prize in a TXT2Win Competition. You should seek independent financial advice about such matters.

16. Blumo in its absolute discretion reserves the right to verify the validity of all entries and to disqualify you if you tamper with the entry process including but not limited to techniques designed to avoid payment of call costs or submission of an entry not in accordance with these terms and conditions.

17. These terms and conditions constitute the entire agreement between you and Blumo.
